EICR Requirements for Liverpool Landlords in 2026

If you are a private landlord in Liverpool in 2026, having a valid EICR for every rental property you own is not optional. It is a legal requirement with fines of up to £30,000 for non-compliance. What Is an EICR and Why Do Landlords Need One?

An Electrical Installation Condition Report is a formal inspection of a property's fixed electrical installation carried out by a qualified electrician. It assesses the condition of wiring, consumer units, sockets, switches, earthing and bonding against the requirements of BS 7671, the UK wiring regulations.

Since 1 June 2020, the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 have made it a legal requirement for all private landlords in England to hold a valid EICR for each rental property. Liverpool City Council is one of the most active local authorities in the country when it comes to enforcement, particularly for HMO properties.

The Legal Requirement in Plain English

Every rental property in Liverpool must have a valid EICR. It must be renewed every five years or at every change of tenancy, whichever comes first. You must give a copy to existing tenants within 28 days of the inspection and to new tenants before they move in. If Liverpool City Council requests a copy you must provide it within 7 days.

How Often Does a Liverpool Landlord Need an EICR?

The maximum interval between EICRs for a rental property is five years. However if a tenant changes before five years is up you must arrange a new inspection before the new tenancy begins. In practice this means landlords with higher tenant turnover need inspections more frequently.

For HMO properties in Liverpool the five-year requirement is the same but the consequences of non-compliance are compounded by the HMO licensing conditions, which also require a valid EICR as a separate condition of the licence.

What Does an EICR Inspection Involve?

The inspection is carried out by a qualified electrician and covers the entire fixed electrical installation in the property. It is non-invasive — no walls need to be opened. For a standard two to three bedroom Liverpool rental property the inspection takes between two and four hours.

C2
Potentially Dangerous

A fault that could become dangerous. The property receives an unsatisfactory result. Remedial works must be completed within 28 days and written confirmation provided to tenants.

C3
Improvement Recommended

Not immediately dangerous but an improvement is advised. The property can still receive a satisfactory overall result with C3 observations present.

Further Investigation Required

Something could not be fully assessed and requires further investigation before a determination on its safety can be made.

What Are the Most Common Reasons Liverpool Rental Properties Fail an EICR?

Liverpool has a high proportion of older housing stock, particularly in areas like Kensington, Toxteth, Wavertree, Anfield and Walton. The most common reasons rental properties in the city receive an unsatisfactory EICR result in 2026 include:

  • Outdated consumer units without RCD or RCBO protection
  • Deteriorated wiring in properties that have not been rewired in decades
  • Inadequate earthing and bonding
  • Absence of mains-wired smoke alarms on circuits connected to the consumer unit
  • Overloaded circuits in properties that have had additional appliances added without circuit upgrades
  • Rubber or fabric-covered original wiring still in situ

What Happens If Your Liverpool Rental Property Fails?

If the EICR returns an unsatisfactory result you are legally required to arrange all necessary remedial works within 28 days of receiving the report. Once the work is completed you must obtain written confirmation from the electrician who carried it out and provide this to your tenants within 28 days of the original report date.

If you fail to arrange remedial works within the required timeframe Liverpool City Council can arrange for the work to be carried out and recover the cost from you, in addition to imposing a financial penalty.

The Consequences of Non-Compliance in 2026

Liverpool City Council can impose a financial penalty of up to £30,000 per property for failing to comply with the EICR regulations. Non-compliant landlords also risk losing the ability to serve a valid Section 21 notice and may face rent repayment orders of up to 12 months rent. The council has been actively enforcing these regulations since 2020 and enforcement has continued to increase.
